Until 1945 contributory negligence was a complete defence. A negligent defendant could avoid paying any compensation if the defendant could show that the victim had in some way contributed to his or her loss. The injustice caused to such victims prompted Parliament to remedy the situation by passing the Law Reform (Contributory Negligence) Act 1945.
