Private nuisance is a tort that is connected to ‘land’. The tort attempts to create a balance between conflicting interests in land. It is different in its relationship with other torts, specifically trespass to land (which requires direct rather that indirect interference) and negligence (where a legal duty must be established to bring a claim).
