This topic is another area of tort law that was introduced into the AQA Unit 4: Tort specification in September 2009. This article covers the main issues that are likely to arise in a problem-solving question.

Product liability cases in tort are subject to the ordinary rules of negligence, as shown in Donoghue v Stevenson where Mrs Donoghue had to prove the ginger beer manufacturer owed her a duty of care, that he had breached that duty and the breach was the cause of her gastro-enteritis and nervous shock.
